Notice to individuals in the EU and Switzerland where Fit3D is the controller of your data: Personal Information you provide to Fit3D will be transferred to the United States for processing. By providing your Personal Information to Fit3D, you consent to this transfer. You should be aware that the European Union has not determined that the United States provides an adequate level of protection for Personal Information. Although Fit3D has committed to abiding by the privacy principles described by the General Data Protection Regulation and has specified methods under which you may enforce your rights, the laws of the United States may not respect such principles. INTRODUCTION
Fit3D is committed to protecting the privacy of personal information that it processes. This Privacy Policy relates to the personal information that Fit3D, INC (“Fit3D”) receives and collects through its web site at www.fit3d.com and other sites owned and operated by Fit3D that refer to this Privacy Policy, and through all other technologies, products and services provided by Fit3D, including its scanners, apps and its hosted products and services (collectively, the “Services”). The term “personal information”, as used in this Privacy Policy, means any information associated with you that is protected under any applicable privacy or data protection law.Fit3D is a leading provider of 3D body scanning products, services and technology. This Policy covers both the public-facing marketing website operated by Fit3D (the “Public Site”) as well as Services provided to its customers. As noted below, certain parts of the Privacy Policy apply only to the Public Site, and certain parts apply only to the Services.Fit3D has relationships with various businesses, researchers and other entities (collectively, “Customers”) which may require Fit3D to collect and process personal information on their behalf. This might happen, for example, if the Customer uses Fit3D’s scanners in its business, or integrates Fit3D’s technology into its own website or mobile app. In these cases, Fit3D will comply with the privacy-related instructions given to Fit3D by the Customer and you should review that Customer’s privacy policy to determine how it uses your information. In this situation, we consider the Customer to be the “controller” of the personal information, and Fit3D to be the “processor” unless Fit3D and the Customer otherwise agree. If you ask Fit3D to provide your personal information to a Customer, then that Customer’s use of personal information will be governed by that Customer’s privacy policy and Fit3D’s use will be governed by this privacy policy. When this happens, then both Fit3D and the Customer will be considered to be “controllers” of the personal information.In all other cases, Fit3D is acting as the “controller” of personal information (such as when we collect information from users of our scanners and applications that are provided to the general public).
NOTICE OF INFORMATION COLLECTED AND USED
We will inform you when we need information that personally identifies you or allows us to contact you or provide you with the Services. Generally, this information is requested when you register for or use our Services, or when you fill out our contact form on our Public Site, or through one of our applications, requesting additional information about our Services. Personal information collected during registration or when you request information from us may include, without limitation, your name and email address.For certain Services, you will be requested to undergo a 3D body scan which uses infrared sensors, and/or other technologies to map out the shape and contours of your body (“body data”). If you use our applications to conduct a 3D body scan, then we may also collect personal information about you in the form of images taken by the application and process those images to create the body data. We may also request additional information about you, including your gender, ethnicity, height, weight, and age. The body data and other data relating to you may be processed for the purpose of supplying goods or services to you, keeping proper records of those transactions and assisting us in the development, debugging and testing of our applications and our Services. The legal basis for this processing is the performance of a contract between you and us (or between you and one of our Customers), taking steps (at your request) to enter into such a contract and/or your specific consent to use such information for these purposes.When performing Services for Customers where Fit3D is the processor, Fit3D may receive body data without any other personally identifying information. In these cases, Fit3D has no ability to identify the individual associated with the body data. Fit3D may use pixel tags, web beacons, and other similar technologies to record information about how individuals access our Services. This information is typically not personally identifiable and may include internet protocol (IP) addresses (or the DNS name associated with it) of the individual's computer, the web site from which the individual linked to our Services, and the browser software the individual is using to access our Services. This information is used in the aggregate to administer computer systems and to make improvements to our Services.Fit3D uses cookies and other technologies on our Public Site and as part of the Services for user session management and to provide a better user experience, including customization of content display. A cookie is text data that a website transfers to the individual's browser from a web server that is stored on the individual's computer hard drive.If you supply any other person's personal data to Fit3D, you must do so only if you have the authority of such person to do so and you must comply with any obligations imposed upon you under applicable laws and regulations.We use Google Analytics to analyze the use of Services. Because we may only access data upon instruction from that Customer, if you wish to make your request directly to us, please provide us with the name of the Customer who submitted your data to us. We will refer your request to that Customer and will support them as needed in responding to your request within a reasonable timeframe.
ONWARD TRANSFER OF INFORMATION
Except for transfers to Customers and as otherwise expressly set forth herein, which we have described above, Fit3D will not disclose any personal information to a third party who is not a Fit3D contractor or agent (“Agent”). For third parties acting as Fit3D’s Agent, Fit3D will use best commercial efforts to determine that the third party, is either subject to the EU Data Protection Directive or has entered into an agreement with Fit3D consistent with this Privacy Policy. Fit3D adheres to the principles of the EU-United States and Swiss-United States Privacy Shield frameworks but does not rely on these Privacy Shield frameworks as a legal basis for transfers of personal data in light of the judgment of the Court of Justice of the EU in Case C-311/18.
SECURITY
Fit3D takes reasonable technical, administrative and physical measures to protect the security of your personal information from unauthorized use, disclosure and alteration.Fit3D provides information and training to all employees who have access to personally identifiable data maintained by Fit3D, and Fit3D employees are responsible for the internal security of such information.Fit3D will not process personal information in any way that is incompatible or inconsistent with the purpose for which such information was collected.You also have a significant role in protecting your information. No one can see or edit your personal information associated with your account without knowing your user name and password, so do not share these with others.
CHILDREN'S PRIVACY
Fit3D does not knowingly collect or maintain information acquired through the Public Site from persons under 13 years of age, and no part of the Public Site is directed to persons under 13 years of age. Any user under 13 years of age should not use or access the Public Site at any time or in any manner. If Fit3D learns that personally identifiable information of persons less than 13 years of age has been collected from our website without verified parental consent, then Fit3D will take the appropriate steps to delete this information.
